Hi unmask the kids supporters! Update on the case vs. Jelly Belly.

As you may know, the See Them Smile case has been consolidated with Tom Devore's case, in that we share the judge and court dates. He had attempted to have the judge's ruling be class action so that it would apply to all IL school kids, but that was denied. So the good news: Judge Grischow did grant Devore's TRO against the emergency order mandating masks. To be clear, Devores lawsuit is separate from ours. He represents only districts that paid him to represent them. Therefore they are the only ones covered on his TRO. Our lawsuit seeks to show Pritzker has no authority to make the mandates and would therefore eliminate the mandates for the entire state. Unfortunately, our TRO was heard in the infancy of all of this and we were denied. So we can’t move forward with our case until Devores is where ours is because our cases were consolidated.

The mask remedy is for the named districts in Devore's case only. BUT Grischow nullified the Emergenct Order that Pritzker made that gave the school districts the ability to quarantine kids without a court order. Remember when he changed the definition of a quarantine and allowed the districts to act as though they were the IDPH so it eliminated the requirement for the IDPH to have to get a court order. Grischow voided that. So we’re back to where the actual law was before Pritzker started issuing orders ( at least on this front). That ruling applies to all students. So if a school district quarantined your kid, you now go back to telling them you don’t consent and the DPH has to get a court order so they don’t deny you due process. That is the only part of this that applies to all students.

The latest I know is that Lance (STS attorney) read the order ( about the TRO not the second one about the class action) and said that the way he reads it, all students in Illinois ( whether named plaintiffs or not) are covered in this. There are several bizarre things about this but I won’t go into all that. I’ll just leave you with the hopeful thought that he thinks it covers all students. As soon as I know more on that I will update again.

Also, about Pritzker filing an appeal. No need to worry. We always knew that was the plan. It’s standard procedure. He could end the mask mandate tomorrow and he’d still appeal because it affects his authority and him having ultimate power. The appeal will not stop the case from moving forward.

I know this is a lot to take in. Wish I had a black and white answer but we have to be patient and stay hopeful.

Hello all, it has been a while since I've updated you all since I was waiting for some important steps to take place. First off, Pritzker's attorney (the AG) has been doing all he can to delay the case, but it is finally moving forward. If you are following the various lawsuits against the tyrant's mandates, you may have heard of Tom DeVore, a downstate attorney who has been representing individual school districts - and winning. Recently, Tom has decided to start taking these cases on as class action so he is now representing many districts in one case, much like our case is being handled. Over the last week or so, it was decided that 1) ours and Tom's cases will be consolidated in downstate Sangamon County (which is good for us since Pritzker's attorney wanted them consolidated in Crook County where the judges are more left-leaning), 2) the cases will also be consolidated under our judge - Grischow. So these are kind of procedural things that had to be taken care of.

Looking ahead, if I understand correctly, DeVore has until 12/15 to put together his briefings, which our attorney has already done. On the 15th Judge Grischow will hear all of the briefings and oral arguments in one hearing. Since Pritzker's attorney has motioned to dismiss these cases (a common practice), the judge's decision will be made on whether to dismiss or not. Apparently the cases are similar in that they are all contesting Pritzker's authority to do what he is doing, they just approach it differently with some of their arguments. So we are in another holding pattern for now.

Hi there Unmask the Kids supporters! I have an update to share on the lawsuit vs. JB "Executive Order" P. However since I have not found a way to lock down this fundraising page to only those who have donated or are truly supportive of the cause but not able to donate, I will share the update in the Lincoln-Way Area Schools Unmask the Kids facebook group. Member requests to this group are vetted by admins so as to minimize spies, and I would hate to divulge our attorney's strategy to anyone trying to undermine us. Hi to all the Fight Pritzker donors! I just received an update on the case that I want to pass along. Our attorney will be filing an ammended complaint in the next day or two to turn this into a class action lawsuit. (Honestly I forget the reasoning behind this, but I will find out if anyone is curious.) He is still waiting for the judge's opinion on the temporary restraining order (TRO). If approved, I believe it will mean the mask mandate can be immediately lifted. There is a preliminary injunction hearing in November. Also if anyone is following the case and sees the haters posting on social media trying to make it look like the case will be dismissed - do not pay attention. It is standard in almost all cases for the defense attorney to file a motion to dismiss, and it is very rarely granted.

The latest AFAIK:

The judge has not issued her opinion yet on the TRO (temporary restraining order) but we are still moving forward.

The Attny General’s motion to dismiss is standard practice and will be addressed in the next hearing.

The amended complaint is being drawn up for new public school plaintiff/parent to sign so we can proceed.

***UPDATE** An amended complaint needs to be filed ASAP because a new public school plaintiff had to be replaced due to the previous parent placing her children in private schools. I thank her for putting herself out there for the time that she did. While we wait on Judge Grischow’s opinion to come in, I wanted to tell you the next steps. We need to get an amended complaint with the public school mom’s name on it. This is somewhat urgent so we can move forward. Lance will then file for class certification (to formally make it a class action lawsuit). We need to get that done sooner rather than later so we keep that November date for the injunction hearing. There are other motions that will need to be addressed (the AG’s motion to dismiss for example). So, the case is still moving forward but it’s kind of behind the scenes now and nothing earth shattering. Just wanted to keep you all aware of what is going on.

Sharing an update from See Them Smile. This is from a few days ago I believe, and there are now 80+ IL school districts represented!

***UPDATE** Just wanted to let you guys know that we are up to 78 districts represented in this lawsuit ! That’s pretty amazing! We started reaching out on August 4th, I believe, right after the mask mandate went into effect and you guys networked and came up with this amazing group of members here. So kudos to you! According to my spreadsheet, we have raised a total of $22, 325 for the lawsuit (this includes the $10,000 retainer). Simply awesome! You guys took a leap of faith and trusted us to pull together an effective lawsuit against our tyrannical governor and we are moving forward full steam ahead. Lance will most likely get Judge Grischow’s opinion today to read so he can determine what needs to happen to get the appeal where it needs to be. I’ll keep you updated as he lets me know where we are. My only concern is that you all will grow tired and want to give up and I just ask you to stay the course and keep the faith. This could be a fight but I know you are up for it. Stay with us. I can promise you that your attorney is a fighter til the end.
