We are getting there and Chippewas of the Thames want to thank you so much for all your contributions to this cause. It's unbelievable that we need to go to court to prove what should have been done in the first place. Duty to consult was never even attempted by Canada with our nation and by allowing the national energy board to approve pipelines through our traditional territory without our consent or even a phone call is wrong. Why does the constitution of Canada get neglected like this? Canadians should be appalled by this non-compliance. Chippewas of the Thames will continue to fight this battle to stop tar sands oil from travelling through Ontario. Let's stand together!

Enbridge wants to run tar sands oil through our traditional territory. When a rupture occurs in this pipeline we will have devastation. Section "35" of the Canadian constitution states consultation is required!  We have not been consulted. Our nation has endured land theft, residential schools, the sixty's scoop, political oppression, under funding and chemical interference. We are challenging Canada in the courts to live up to their constitutional obligation to consult with us on a nation to nation basis. Their Duty to consult was not initiated and they cannot extend that obligation to a third party, the national energy board, to make decisions such as approving enbridge's line 9 pipeline. We know our challenge will be met by strong opposition from governments and corporations but all Canadians want a healthy and safe environment for themselves and future generations. We will endure this challenge and are respectfully seeking financial or in-kind support as this legal cost will be very high. As the indigenous people of North America we will always defend the safety of our Mother Earth! Thank you!

We have teamed up with Clyde River First Nation to enter the Supreme Court with as our challenge is similar, we are getting closer to court. Thank you so much for your support as costs are increasing but we remain dedicated to winning this fight for protecting our Mother Earth!

Update: June 22, 2015
First of all, thank you all so much for your support at our court hearing in Toronto on June 16th. Thank you so much for your gracious donations to this cause. We are in a "wait" mode as the decision of the court could be days or weeks away. We felt optimistic after the hearing but the courts can rule either way. The problem now is that after Enbridge fulfills it's new hydro testing obligation it will open the line. We are at a point now that major decisions have to be decided.
Options:
1. Wait for a decision from courts and if it is in our favour ask to quash the decision of the NEB.
2. Apply for a judicial review which is very very expensive but effective.
3. Appeal the stay decision, which will be tough.
4. Apply for an injunction, this will be hard to determine irreparable damage on an existing pipeline.
We are going to push for a judicial review but this requires a band council motion and lots more support. We would like to organize community outreach with pamphlets and information circles. We want to do everything possible to stop line 9. We feel it is outrageous that we need to pay these high costs to continue fighting large corporations in order to sustain our Mother Earth! Plus, pay to have Canada live up to the treaties and constitutional responsibility of duty to consult! Thank you all! Chippewas of the Thames is honoured to stand beside you on this important task!

Thanks so much for your contributions both money and in-kind support. We are expecting a large rally at the court house at 180 Queen St. West Toronto on June 16th. Court starts at 9:30 and the rally starts at 11:00am! If you can come and support Chippewa's legal stance because Canada still has not consulted our nation and has given authority to a third party entity, the National Energy Board to approve projects like Enbridge pipelines line 9b. We lost our bid for a stay from the NEB so support is crucial at this time. Chippewa will fight as hard as we can but we need solidarity from all! Thank you!
